This is a first version of our Terms of Service, covering the pre-launch waitlist stage. We'll expand it as Esteemly launches and new features ship.
By accessing the Esteemly website or joining our waitlist, you agree to be bound by these Terms of Service. If you do not agree, please do not use the site. We may modify these Terms at any time; modifications take effect once posted here, and continued use after a change means you accept the updated Terms.
Esteemly is currently in a pre-launch, waitlist stage. We're building an AI-powered platform that generates custom marketing websites for individual professionals: therapists, lawyers, coaches, nutritionists, and other service providers. Today, our Services consist of waitlist management, information about our roadmap, and updates about our launch. No Services are available for paid use yet, and there is no fee to join the waitlist. Once we launch, Services will expand to include generating a personalized website from your professional profile and intake information.
We grant you a limited, non-exclusive, non-transferable, revocable license to access the website solely to join the waitlist and learn about Esteemly. This license does not include the right to reproduce, distribute, or publicly display site content; create derivative works from it; use it for a commercial or competing purpose; remove proprietary notices; scrape or access the site through automated means without permission; or use the site for any unlawful purpose.

All content on the site (text, graphics, logos, images, and software) is the property of Esteemly or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not use this content without our written permission. Once Esteemly launches, the AI-generated website created for you will be owned by you; Esteemly retains ownership of the underlying technology and templates used to generate it, and you'll receive a license to use your site for your professional practice.
When you join the waitlist and share professional details, a biography, or other information ("User Content"), you grant Esteemly a worldwide, non-exclusive, royalty-free license to use it to build your eventual website, improve our Services, and communicate with you. You represent that you own or have the right to share this content, that it's accurate, and that it doesn't infringe on anyone else's rights. You retain all rights to your User Content and may request its deletion at any time.
The website and Services are provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We don't warrant that the site will be uninterrupted, secure, or error-free, or that any defects will be corrected. Your use of the site is at your own risk.
To the fullest extent permitted by law, Esteemly is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, revenue, or data, arising from your use of the site, even if we've been advised of the possibility. Our total liability for any claim arising from these Terms or your use of the site will not exceed one hundred dollars ($100). Some jurisdictions don't allow these limitations, so they may not apply to you.
You agree to indemnify and hold Esteemly, its officers, employees, and agents harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the site, your violation of these Terms or any law, your User Content, or your conduct toward others.
The site may link to third-party websites or services not operated by Esteemly. We don't endorse or take responsibility for them, and these Terms don't apply to them; their own terms and privacy policies govern your use.
Your use of the site and any information you provide are governed by our Privacy Policy, which explains how we collect, use, and share your data.
We may restrict or terminate your access to the site at any time, for any reason, including violation of these Terms, unlawful use, provision of false information, or conduct we reasonably deem harmful to the site or other users. Upon termination, your right to use the site ends immediately.
Esteemly is under active development, and we may change, suspend, or discontinue any part of the site or Services at any time. As the product moves from waitlist to launch and beyond, these Terms may change materially to reflect new features and fees. We'll update the "Last updated" date whenever we make a material change, so please check back periodically.
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law principles. Any dispute will be resolved through good-faith negotiation first; if that fails, it will be brought exclusively in the state or federal courts located in Delaware.
If any provision of these Terms is found unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will stay in effect. These Terms, together with our Privacy Policy, are the entire agreement between you and Esteemly regarding the site. Our failure to enforce any provision isn't a waiver of it.
